California Privacy Declaration

Last updated: April 1, 2026

This California Privacy Declaration (“Notice”) applies to California residents and describes how Air Trust SD (“we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information as defined under the California Consumer Privacy Act of 2018 (“CCPA”) as amended by the California Privacy Rights Act of 2020 (“CPRA”).

1. Scope of this Notice

This Notice applies to personal information we collect in connection with our website, lead forms, phone or email communications, marketing activities, and the delivery of HVAC, air quality, and related home services when you are a California resident. If you interact with us solely in a capacity that is not covered by the CCPA/CPRA (for example, certain business-to-business communications), different rules may apply.

2. Categories of personal information we collect

Depending on how you interact with us, we may collect the following categories of personal information: Identifiers (such as name, email address, phone number, postal address, and online identifiers); Customer records information (such as payment or billing details when you purchase services); Commercial information (such as services purchased or considered); Internet or other electronic network activity (such as browsing activity on our website, device information, and interactions with our digital properties); Geolocation data (such as general location derived from your address or IP); Professional or employment-related information (when relevant to commercial accounts); Inferences drawn from the above to create a profile reflecting preferences or characteristics; and Sensitive personal information only where permitted by law and with any notice or choice required (for example, account log-in credentials if you create an account, if applicable). We do not use sensitive personal information for purposes that require a “Limit the Use of My Sensitive Personal Information” link under CPRA unless we are required to provide that link.

3. Sources of personal information

We collect personal information directly from you (for example, when you submit a form, call us, or email us), automatically when you use our website (for example, through cookies and similar technologies, where permitted), and from third parties such as service providers, analytics partners, advertising networks, data brokers (if any), or lead partners, as permitted by law.

4. Business or commercial purposes for collection and use

We use personal information to provide, schedule, and perform services; communicate with you about estimates, appointments, and service quality; process payments; operate, maintain, and improve our website and customer experience; personalize content and offers where appropriate; conduct analytics and measure advertising performance; maintain security and prevent fraud; comply with legal obligations; enforce our terms; and for other purposes disclosed at the time of collection or as otherwise permitted by the CCPA/CPRA.

5. Disclosure of personal information

We may disclose personal information to service providers and contractors that perform services on our behalf under written contracts that meet CCPA/CPRA requirements (for example, hosting, customer relationship management, scheduling, payment processing, analytics, marketing, and communications vendors). We may also disclose information as required by law, in connection with legal process, to protect rights and safety, or in connection with a merger, acquisition, financing, or sale of assets, subject to applicable law.

6. “Sale,” “sharing,” and targeted advertising

We do not sell personal information for money. We may use cookies or similar technologies that could constitute “sharing” for cross-context behavioral advertising or “targeted advertising” under California law, depending on our partners and your settings. Where required, we will honor opt-out preference signals and provide appropriate choices as described below.

7. Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Notice, unless a longer retention period is required or permitted by law. Retention periods vary based on the nature of the information and our business, legal, and operational needs.

8. Your California privacy rights

If you are a California resident, you may have the following rights, subject to exceptions under applicable law: Right to know/access: You may request the categories and specific pieces of personal information we collected, the categories of sources, business or commercial purposes, and categories of third parties to whom we disclose personal information. Right to deletion: You may request deletion of personal information we collected from you, subject to certain exceptions. Right to correction: You may request correction of inaccurate personal information. Right to opt out of sale/sharing: You may opt out of the sale or sharing of personal information for cross-context behavioral advertising, where applicable. Right to limit use of sensitive personal information: You may have the right to limit certain uses of sensitive personal information, where applicable. Right to nondiscrimination: We will not discriminate against you for exercising these rights. You may also have rights related to automated decision-making profiling in limited circumstances; we describe any material profiling practices if and as required.

9. How to submit a request

To exercise your rights, contact us using the email address or phone number shown on our Contact page. We will verify your request in accordance with applicable law, which may require you to provide information that allows us to reasonably verify your identity. You may designate an authorized agent to submit a request on your behalf; we may require proof of authorization and verification. If we deny your request, you may appeal the decision where permitted by contacting us and stating that you wish to appeal.

10. Shine the Light

California residents may request information regarding certain disclosures of personal information to third parties for their direct marketing purposes under California’s “Shine the Light” law, where applicable. Because we do not engage in that type of disclosure as defined by that law, we may respond that no such disclosure occurred.

11. Children

Our services are not directed to children under 16, and we do not knowingly sell or share personal information of minors under 16 without affirmative authorization as required by law.

12. Changes to this Notice

We may update this Notice from time to time. When we make material changes, we will post the updated Notice on this page and update the “Last updated” date. Your continued use of our website or services after the effective date may constitute notice where permitted by law.
